This is an action against Thorp Finance Corporation and William E. Nuesse, commissioner of banks of the state of Wisconsin, for a judgment declaring that Thorp may not carry on its alleged collection business without being licensed under sec. 218.04, Stats. The action was brought by the Wisconsin Collectors Association, Inc. (hereinafter called the association), comprised of approximately 70 licensed collection agencies in Wisconsin, and by Mr. Hilding Haag, the operator of a licensed collection agency, on behalf of all members of the association and all licensed collectors in the state of Wisconsin.
